Shire of Kulin Local Laws Review

The Shire of Kulin is reviewing its local laws to ensure they remain current. Local Shire laws govern a range of operational and community matters, in addition to, and not in replacement of, any other State legislation requirements. Section 3.16 of the Local Government Act 1995 requires that all local laws be reviewed within a 15-year period after their commencement to determine if they should be repealed, be amended or remain unchanged. The 15-year period is taken to be from either when the local law commenced or when the last review of the local law was completed. The transitional provisions of the Local Government Amendment Act 2024 require the Shire of Kulin to review all local laws within a two (2) year period, prior to 7 December 2026, unless a review of the local law occurred within the last eight (8) years, or they will automatically lapse by that date. The Shire of Kulin Health Local Laws 2016 and the Shire of Kulin Animals, Environment and Nuisance Amendment Local Law 2018 require review or they will automatically lapse.

At the Ordinary Meeting of the Shire of Kulin Council held on 29 July 2026, Council resolved to commence a review of all of its local laws in the interests of efficiency and alignment of timing of review.  Submissions may be made about any of the local laws as outlined in the below public notice. After submissions close, the Shire of Kulin will consider any submissions received and report to Council for its review and consideration of any recommendations as to whether the local law/s should be retained, amended or repealed. Any proposed repeal or amendment of the local law/s arising from Council’s consideration will be advertised for the required statutory period for public review and submissions.
